Please read carefully before using the services offered by Beautiprints.com

Beautiprints.com provides users with an automated online platform to design and sell t-shirts and other merchandise. By accessing or using Beautiprints.com in any way, you agree to the terms and conditions outlined in this Terms of Service Agreement ("Agreement"). The following terms govern your use of Beautiprints.com, and by continuing to use this website, you confirm that you have read, understood, and accepted these terms. For further details or clarification, please refer to the Frequently Asked Questions (FAQ) section on Beautiprints.com.

SECTION 1 - USER AGREEMENT

By violating any part of this User Agreement, you may face immediate consequences, including the removal of your campaign(s), forfeiture of any profits earned, and potential suspension or termination of your account.

Beautiprints.com provides its website and related services to you (“Seller” or “you”) under this User Agreement (the “Agreement”), which includes the Intellectual Property Complaint Policy, Counter-Notice Policy, Repeat Intellectual Property Complaint Policy, Refund Policy, and Privacy Policy. Together, these policies and agreements constitute the complete "Terms of Service" for Beautiprints.com. All the obligations outlined in these policies are fully incorporated by reference into this Agreement.

DELIVERY PROCEDURE

Any delivery timeframes provided by Beautiprints.com are estimates only. Delays in shipping or delivery do not absolve the Seller of any obligations under this Agreement. Beautiprints.com cannot guarantee delivery times due to factors beyond our control, such as postal delays, weather conditions, or supply chain disruptions.

PRINT VARIANCE

The products you sell through Beautiprints.com are printed based on the artwork you, as the Seller, upload. The estimated positioning and size of the artwork provided by the Seller may vary slightly depending on the size of the product. Additionally, colors will be matched as closely as possible to the artwork submitted, but Beautiprints.com does not guarantee an exact match for print size, location, or colors, as production factors may influence the final product. Variances in print quality are a standard possibility due to the materials and processes involved.

PRICE AND PAYMENT

The Seller sets the selling price for each campaign on Beautiprints.com. Beautiprints.com processes all customer payments on behalf of the Seller. The base price, which is deducted from the sale price, covers the cost of production and any additional expenses or fees required under this Agreement. After deducting the base price and applicable fees, the remaining balance constitutes the Seller's profit (“Seller Profits”), which Beautiprints.com will remit to the Seller.

SECTION 2 - BY CREATING A CAMPAIGN ON BEAUTIPRINTS.COM:

You confirm that you agree to fully comply with all terms outlined in this Agreement.

If you are using any licensed trademarks, service marks, or copyrights, you agree to adhere to any and all restrictions or conditions imposed by the owner of these rights.

You agree that you either own, or have the appropriate license for, any artwork or text that you upload or create for your merchandise. This includes, but is not limited to, trademarks or copyrights associated with your uploaded content. If you do not own the rights to certain content, you agree to provide evidence of permission from the rightful owner to Beautiprints.com if requested.

You acknowledge that the description and title of your campaign, as well as any text or images associated with your merchandise, do not infringe upon the rights of any third party.

You understand that Beautiprints.com reserves the right to remove any content it determines promotes hate speech, violence, racial intolerance, or the exploitation of a crime.

You acknowledge that Beautiprints.com may, at its sole discretion, provide your contact information to a third party asserting, under Beautiprints.com's Intellectual Property Complaint Policy, that their intellectual property rights are being infringed by your campaign or content.

If Beautiprints.com receives a complaint that complies with its Intellectual Property Complaint Policy, it may, at its discretion, immediately cancel your campaign, forfeit any profits associated with the campaign, and suspend or terminate your account without prior notice.

You agree not to post inaccurate or misleading information in your campaign, including details about the product for sale, its origin, or the intended recipient of profits.

You agree not to solicit buyers through your campaign for anything other than the primary merchandise being sold. This includes, but is not limited to, offering raffles, sweepstakes, or other promotions beyond the sale of the listed product.

You agree to defend, indemnify, and hold harmless Beautiprints.com, its affiliates, and its officers, directors, and employees from any claims, damages, expenses, or costs (including legal fees) arising from your use of Beautiprints.com’s services, your violation of this Agreement, or any infringement of third-party rights.

You acknowledge that Beautiprints.com is not responsible for indirect or special damages, including lost profits, resulting from actions taken in compliance with this Agreement or your use of Beautiprints.com services.

INTELLECTUAL PROPERTY RIGHTS AND LICENSE

By submitting your campaign or listings to Beautiprints.com, you grant Beautiprints a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display your content in connection with Beautiprints.com's services. This license includes the right for Beautiprints.com to promote and redistribute your listings through any media formats or channels. You also grant each user of Beautiprints.com a non-exclusive license to access your content and use, reproduce, or display it according to the functionality of the site and this Agreement.

This license terminates within a reasonable time after you remove your listings from the site. However, any user comments you submit remain perpetually and irrevocably licensed to Beautiprints.com.

All intellectual property rights on the Beautiprints.com website and its services—including the underlying software, graphics, logos, text, and designs—are owned by or licensed to Beautiprints.com. Except as authorized by law or this Agreement, you may not copy, reproduce, or otherwise use any content from the site without written permission from Beautiprints.com.

SECTION 3 - INTELLECTUAL PROPERTY COMPLAINT POLICY

Beautiprints.com provides a platform for Sellers to create and sell their merchandise. By using the platform, you agree not to infringe on the intellectual property rights of third parties, such as copyright, trademark, or publicity rights. Beautiprints.com reserves the right to block or remove content that it deems to violate intellectual property rights, based on a complaint submitted in accordance with Beautiprints.com’s Intellectual Property Complaint Policy. Accounts of repeat offenders may be terminated.

If you believe your intellectual property rights have been infringed by a Seller on Beautiprints.com, you must notify Beautiprints.com at legal@beautiprints.com with the following information:

  • Your physical or electronic signature.
  • The URL of the campaign in question.
  • Identification of the copyright, trademark, or other intellectual property rights allegedly infringed, along with proof of ownership.
  • Your contact information, including your full name, address, phone number, and email address.
  • A statement made in good faith that the use of the material is unauthorized and constitutes an infringement under applicable law.
  • A declaration, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the owner of the intellectual property.

SECTION 4 - COUNTER-NOTICE POLICY

If you believe that a claim of intellectual property infringement was mistakenly filed against you, you may submit a counter-notice. Misrepresenting a non-infringing status may result in liability for damages, including legal fees. The counter-notice should be sent to legal@beautiprints.com and must include the following information:

  • Your physical or electronic signature.
  • Your contact information.
  • A description of the removed material and its location prior to removal.
  • A statement, under penalty of perjury, that the removal of the material was an error.
  • Your consent to the jurisdiction of a federal court, based on your location, and your agreement to accept service of process from the party that submitted the original claim.

Beautiprints.com will forward your counter-notice to the party that submitted the claim. Unless the rights holder files a legal action against you within 10 business days, Beautiprints.com may restore the removed material within 10-14 business days.

SECTION 5 - REPEAT INTELLECTUAL PROPERTY COMPLAINT POLICY

Beautiprints.com tracks repeat violations of intellectual property rights. Accounts that receive multiple complaints may be terminated. Beautiprints.com reserves the right to terminate accounts for any violation that contravenes the spirit of the Terms of Service, regardless of the number of offenses.

SECTION 6 - WITHHOLDING AND TAX MATTERS

Beautiprints.com does not anticipate withholding taxes under U.S. Internal Revenue Code Section 1442. However, should a withholding obligation arise, Beautiprints.com will deduct the appropriate amount of tax from Seller Profits. Sellers are responsible for their own tax liabilities and agree to indemnify Beautiprints.com for any related tax obligations.

SECTION 7 - INDEMNIFICATION

As a Seller on Beautiprints.com, you agree to indemnify, defend, and hold harmless Beautiprints.com, its affiliates, employees, officers, directors, agents, and any third-party service providers from and against any claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, arising from or in any way related to:

(i) any content you submit, post, or transmit through Beautiprints.com;

(ii) your use of the website and services provided by Beautiprints.com;

(iii) your violation of any term of this Agreement or the Terms of Service;

(iv) your violation of any third party’s rights, including but not limited to, intellectual property rights, privacy rights, or proprietary rights; or

(v) your breach of any applicable law or regulation.

This indemnification obligation will survive the termination of this Agreement and your use of the Beautiprints.com website and services. You agree to cooperate fully in the defense of any claim that Beautiprints.com may deem necessary. Beautiprints.com reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not, in any event, settle any claim or matter without the prior written consent of Beautiprints.com.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Beautiprints.com, its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

(i) your access to or use of, or inability to access or use, Beautiprints.com’s services;

(ii) any conduct or content of any third party on Beautiprints.com’s platform, including but not limited to, any defamatory, offensive, or illegal conduct of other users or third parties;

(iii) any content obtained from Beautiprints.com’s services;

(iv) unauthorized access, use, or alteration of your content or account information.

In no event shall Beautiprints.com’s total liability for all claims related to the services exceed the greater of $100 USD or the amount paid by you to Beautiprints.com in the past six months for services giving rise to the claim.

Beautiprints.com does not assume any responsibility or liability for any content provided by users or third parties or for any failure of performance or interruption of services.

DISCLAIMER OF WARRANTIES

You understand and agree that your use of Beautiprints.com’s services is at your sole risk. Beautiprints.com’s services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Beautiprints.com expressly disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Beautiprints.com makes no warranty that:

(i) the services will meet your requirements;

(ii) the services will be uninterrupted, timely, secure, or error-free;

(iii) the results that may be obtained from the use of the services will be accurate or reliable;

(iv) the quality of any products, services, information, or other material purchased or obtained by you through Beautiprints.com will meet your expectations.

No advice or information, whether oral or written, obtained from Beautiprints.com or through the services shall create any warranty not expressly stated in this Agreement.

SECTION 8 - MISCELLANEOUS PROVISIONS

RELATIONSHIP OF THE PARTIES

This Agreement does not create any agency, partnership, joint venture, employment, or fiduciary relationship between you and Beautiprints.com. Neither party has any authority to bind the other to any contract, agreement, or obligation with a third party, nor can either party incur any obligation on behalf of the other.

ENTIRE AGREEMENT

This Agreement, along with the other policies incorporated by reference (such as the Privacy Policy and Refund Policy), constitutes the entire agreement between you and Beautiprints.com regarding your use of the services. This Agreement supersedes any prior or contemporaneous agreements, communications, proposals, or representations, whether oral or written, between you and Beautiprints.com.

ASSIGNMENT

You may not assign or transfer any of your rights or delegate any of your obligations under this Agreement without Beautiprints.com’s prior written consent. Beautiprints.com reserves the right to assign or transfer its rights and obligations under this Agreement at any time without prior notice to you.

SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under any applicable law, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of this Agreement, which shall remain in full force and effect.

WAIVER

Beautiprints.com’s failure to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision.

GOVERNING LAW; VENUE

This Agreement and all related matters shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree that any legal action or proceeding arising under or related to this Agreement shall be brought exclusively in the federal or state courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of such courts.

WAIVER OF JURY TRIAL

Each party hereby waives any right to a trial by jury in any legal action or proceeding arising out of or relating to this Agreement.

SECTION 9 - BUYER PAYMENTS, RETURNS, REFUNDS, AND CANCELLATION POLICY

By placing an order through Beautiprints.com, you agree to the terms of payment, returns, refunds, and cancellation policies as outlined below. Beautiprints.com is committed to providing a seamless and satisfactory shopping experience for both buyers and sellers.

PAYMENT METHODS

Beautiprints.com accepts various forms of payment, including VISA, MasterCard, American Express, and PayPal. Payments must be made in full at the time of placing an order.

TIME OF PAYMENT

Payments are required at the time of order submission due to the on-demand nature of product fulfillment. Orders will not be processed until full payment is received.

SHIPPING AND DELIVERY TIMES

Products ordered through Beautiprints.com, especially apparel, are produced on-demand after the completion of your order. Most orders are expected to be delivered within 14-21 business days. However, delivery times may vary due to factors beyond Beautiprints.com’s control, such as postal delays or natural disasters.

INTERNATIONAL SHIPPING

Certain countries do not provide international tracking after the shipment leaves the origin country. Beautiprints.com is not responsible for delays or lost shipments in international orders. Buyers are encouraged to check with their local post office to inquire about carriers that handle deliveries in their region.

LOST OR STOLEN SHIPMENTS

Beautiprints.com cannot guarantee successful delivery for every shipment, especially in high-risk locations known for issues such as lost or stolen packages. Buyers assume the risk of shipment loss once the package is in transit, and Beautiprints.com is not liable for these losses.

CANCELLATIONS, REFUNDS, & EXCHANGES

If you receive a product that is incorrect (wrong size, color, or design), you must contact Beautiprints.com within 30 days of delivery to request a refund or replacement. Claims are handled on a case-by-case basis. For orders shipped outside the U.S., support will be provided within 60 days of delivery. Other than cases involving faulty goods, orders are final and cannot be canceled or returned.

SECTION 10 - API (SHOPIFY, WOOCOMMERCE, …) POLICY

OVERVIEW

Beautiprints.com offers integration with third-party platforms, such as Shopify and WooCommerce, to allow sellers to manage their merchandise listings, orders, and fulfillment through these applications. All content, data, and material available through the Beautiprints.com API or any related applications are the property of Beautiprints.com. Sellers using the Beautiprints.com API agree to abide by these terms and all other relevant policies outlined in this Agreement.

By accessing or using any part of the Beautiprints.com API or third-party platform applications, such as Shopify or WooCommerce, you (“Seller” or “you”) agree to be bound by the following terms and conditions, as well as Beautiprints.com’s full Terms of Service. Any breach of these terms may result in the suspension or termination of your access to the Beautiprints.com API and other services.

USE OF API MATERIALS

All materials, including text, images, and data provided by Beautiprints.com via the API, are protected under copyright law and may not be reproduced, distributed, or used without prior written consent from Beautiprints.com. You agree not to use language or images that are threatening, abusive, vulgar, defamatory, or that infringe upon the rights of any third party. Additionally, you agree not to transmit any content that contains a virus or other harmful component that could damage the Beautiprints.com API or third-party platforms.

Beautiprints.com reserves the right to remove or modify any content submitted through the API that violates this Agreement or applicable laws, or that Beautiprints.com deems inappropriate or harmful to its platform.

INTEGRATION WITH THIRD-PARTY PLATFORMS

Beautiprints.com offers integration with third-party platforms such as Shopify and WooCommerce to enable sellers to create and manage campaigns, process orders, and fulfill product listings. The seller is responsible for complying with the terms and policies of these third-party platforms, in addition to the terms set forth by Beautiprints.com. Beautiprints.com is not responsible for any third-party platform’s policies, outages, or limitations that may affect the Seller’s campaigns or services.

By utilizing these integrations, Sellers agree to:

  • Maintain compliance with the terms and conditions of both Beautiprints.com and the third-party platform being used (e.g., Shopify, WooCommerce).
  • Ensure that all product descriptions, images, and listings comply with Beautiprints.com’s guidelines and the applicable third-party platform’s terms.
  • Use the integration only for its intended purpose and avoid any malicious use that could affect the performance of Beautiprints.com’s API or the third-party platform.

CHANGES TO API FUNCTIONALITY

Beautiprints.com reserves the right to update, modify, or discontinue its API and any related third-party integrations at any time without prior notice. Changes to the API may affect the functionality of your campaigns or listings on third-party platforms, and it is your responsibility to adapt to these changes. Beautiprints.com will not be liable for any disruptions or loss of functionality caused by changes or discontinuation of the API.

Beautiprints.com may, at its discretion, provide notices of updates to the API through email or other communication channels but is not obligated to directly notify each individual Seller.

DATA USAGE AND STORAGE

The Beautiprints.com API may provide access to certain data, including sales figures, customer information, and order details, for the purpose of fulfilling and managing campaigns. Sellers agree to use this data in compliance with applicable privacy and data protection laws, and not to misuse or share the data with unauthorized third parties.

Beautiprints.com will store certain information related to your campaigns and transactions as part of its services. Beautiprints.com’s Privacy Policy governs how this information is collected, stored, and used. By using the API, you consent to Beautiprints.com’s data collection and usage practices as outlined in its Privacy Policy.

LOST / STOLEN SHIPMENTS

Sellers who use Beautiprints.com in conjunction with third-party platforms are responsible for all aspects of order fulfillment, including the handling of lost or stolen shipments. Beautiprints.com cannot guarantee successful domestic or international shipments, especially for high-risk destinations known for lost or stolen goods. Shipping products both domestically and internationally is done at the sole risk of the Seller. Beautiprints.com is not liable for shipments that are delayed, lost, or stolen once they are handed over to the carrier.

For international shipments, certain countries may not provide tracking once the shipment leaves the origin country. Sellers are responsible for determining the appropriate carrier in these cases and are encouraged to communicate with customers to ensure timely delivery.

PRINTING & PRODUCTION

Beautiprints.com prohibits the use of its services to sell merchandise that infringes upon third-party intellectual property rights, including copyright, trademark, trade dress, and publicity rights. All merchandise production is based on the artwork and designs provided by the Seller. Sellers are responsible for ensuring that their artwork complies with Beautiprints.com’s intellectual property policies.

The print size, color, and placement of designs may vary slightly depending on the product’s size and the production process. Beautiprints.com cannot guarantee exact matches to the uploaded artwork, and slight variations in the finished product are to be expected. In cases where production issues arise, Sellers are responsible for monitoring and managing orders through the third-party platform (e.g., Shopify, WooCommerce) and resolving any issues directly with customers.

Sellers are responsible for checking the “Action Required” tab within the third-party platform to address any payment or address issues that may arise before production can proceed. Beautiprints.com is not responsible for processing delays caused by unresolved issues within third-party platforms.

TERMINATION

Beautiprints.com reserves the right to terminate or suspend your access to the API and related third-party integrations if you violate any of the terms in this Agreement or any related policies. Beautiprints.com may also terminate your access if it believes your usage could harm its platform, customers, or business operations.

This Agreement is effective until terminated by either party. You may terminate this Agreement at any time by discontinuing your use of the Beautiprints.com API and third-party platform integrations, and by destroying any materials obtained from these services.

DISCLAIMER

Beautiprints.com does not guarantee the functionality, reliability, or accuracy of third-party platform integrations. Any third-party services or platforms connected to Beautiprints.com’s API are used at your own risk, and Beautiprints.com is not responsible for any downtime, disruptions, or data losses caused by these third-party services.
