A statement made in good faith asserting that the material in question is being used without authorization from the owner, their agent, or the law.
A declaration, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the intellectual property owner.
COUNTER-NOTICE POLICY
If you believe a claim of intellectual property infringement against your content was submitted in error or is a case of misidentification, you have the right to file a counter-notice. Be aware that misrepresenting your content as non-infringing in a counter-notice could result in liability for damages, including legal fees and costs. If you are uncertain about whether your material infringes on intellectual property, seeking legal advice before filing a counter-notice is highly recommended.
To submit a counter-notice, please email [email protected] with the following details:
Your physical or electronic signature.
Your full name, address, telephone number, and email address.
A description of the material in question and its location before removal, including the relevant URL or campaign number.
A statement, under penalty of perjury, that the takedown of your material was a mistake or due to a misidentification.
Your agreement to the jurisdiction of a federal court in your area (if located in the U.S.) or the jurisdiction of the court where your service provider operates (if located outside the U.S.).
Your consent to accept service of process from the individual or entity that filed the original complaint or their representative.
Upon receiving your counter-notice, Beautiprints may forward it to the party who filed the initial claim. Unless legal action is taken by the complainant within 10 business days, the content may be restored or access to it reinstated within 10-14 business days after the counter-notice is received.
REPEAT INTELLECTUAL PROPERTY COMPLAINT POLICY
If Beautiprints receives repeated reports that you have used intellectual property without proper authorization, your account may be deactivated. Beautiprints monitors for repeated infringement and will take appropriate action, which may include suspending or permanently terminating accounts.
Beautiprints also reserves the right to close accounts that violate the intent of our Terms of Service, regardless of the number of complaints received.
